Article 1 (Purpose)

These terms and conditions prescribe the conditions and procedures for use of services offered by <InnoGate> organized by the Ministry of Trade, Industry and Energy and operated by KOTRA; matters related to the rights and duties of <InnoGate> and users; and other required matters.

Article 2 (Effects and Changes of the Terms and Conditions of Use)

• 1. These terms and conditions of use shall take effect upon posting on <InnoGate>.
• 2. If the terms and conditions of use are modified, the effective date and reasons for modification shall be indicated and posted on the website from seven (7) days prior to the scheduled amendment to one (1) day prior to the effective date along with the present terms and conditions of use. If the terms and conditions of use modified are unfavorable to the users, a grace period of at least thirty (30) days shall be granted before notification.
• 3. If users do not agree to the terms and conditions of use modified, they shall be allowed to withdraw from membership of <InnoGate>. If users continue to use the terms and conditions of use, they shall be considered to have agreed to the terms and conditions of use.

Article 3 (Working Rules in Addition to the Terms and Conditions of Use)

Matters not specified in the terms and conditions of use shall comply with the Framework Act on Telecommunications, the Telecommunications Business Act, the Deliberation Regulations of Information Communication Ethics Committee, the Information Communication Ethics Code, the Computer Program Protection Act and other related laws and regulations.

Article 4 (Definitions)

The terms used here shall be defined as follows:

• 1. “Service” : means information offered by <InnoGate> including introduction of programs and events, information on amenities, newsletters, etc.
• 2. “Members” : means those who are allowed to use services offered by <InnoGate>, such as corporate members having registered their corporate information with <InnoGate>, individual members who have provided their personal information, and investors who have registered for membership.
• 3. “Users” : means those who receive services from <InnoGate>.

Article 5 (Establishment of Service Use Agreement)

• 1. This Service Use Agreement shall be established by users filling out the membership information according to the form specified by <InnoGate> and expressing their intention to comply with the terms and conditions of use.
• 2. <InnoGate> shall cancel a membership if the following applies among the users who applied for membership as specified in paragraph 1.
• Having presented falsified or redundant applications for membership
• Having applied for membership for the purpose of undermining public order or established social morals and good manners
• Having violated the terms and conditions of use or dramatically disturbed the operation of <InnoGate>
• If an administrator with <InnoGate> deems it necessary

Article 6 (Consent to Use of Membership Information)

• 1. This Privacy Policy shall be applied to the member’s personal information.
• 2. Collected membership information shall be used only for the purpose of operating or enhancing <InnoGate> services.
• 3. Membership information collected by <InnoGate> shall not be disclosed to a third party without obtaining consent from the user.
• 4. <InnoGate> shall be allowed to offer personal information, such as user name and email address to a third party to the extent permitted by law if:
• If an investigative agency or other government agency makes a request for the information of the user in violation of applicable law in using the service
• If it is deemed necessary to protect information due to legal violation or illegitimate activities with regard to the terms and conditions of laws
• If it is requested in accordance with other laws and regulations

Article 7 (Changes in Membership Information)

If personal information offered at the time of application for membership is changed, users may correct it online in person or request an administrator to modify it. Users shall be responsible for problems caused by unchanged information.

Article 8 (Withdrawal from and Cancellation of Membership)

• 1. If users intend to withdraw their membership, they shall follow the stipulated procedures for withdrawal of membership from <InnoGate> or make a request via phone or email.
• 2. If any of the following reasons arise, <InnoGate> may cancel membership without prior notice.
• Theft of member ID and password from another member
• The conduct of activities that might or could cause harm others
• If users make or execute a plan that might undermine public order or established social morals and good manners by instigating speculative behavior or posting vulgar and pornographic content
• In the case of improperly damaging other people’s information or collecting, storing, infringing, stealing or leaking other’s personal information
• In the case of sending unwanted or unauthorized advertising, promotional materials, or junk or spam mail
• If users send advertising emails despite the explicit rejection of recipients
• If users conduct activities that are prohibited in accordance with related laws or that violate the terms and conditions of use
• If an administrator with <InnoGate> finds it necessary

Article 9 (Service Hours)

• 1. Service hours that are not directly assisted by an administrator shall be 24 hours a day during the event period unless otherwise indicated. However, the service might be suspended due to natural disasters or systems checks.
• 2. Service provided directly by an administrator shall in principle be confined to working hours of <InnoGate>.

Article 10 (Limitation and Suspension of Provision of Services)

• 1. <InnoGate> shall be allowed to limit or suspend provision of the entire service or part thereof for the following reasons.
• If a natural disaster, national emergency, changes in governmental budget or other force majeure events occur or might occur
• If maintenance, construction or disruption of service facilities is necessitated
• Due to disruption caused by service flooding
• If a common carrier suspends telecommunications services
• If it is deemed necessary by an administrator of <InnoGate>
• 2. <InnoGate> shall not be held responsible for any problems caused by service outrages.

Article 11 (Changes in Services and Membership Services)

• 1. The content of services offered to users shall be determined by policy made by <InnoGate> and may be changed or suspended.
• 2. <InnoGate> shall neither take responsibility for losses or profits that users expect to sustain or gain from using services, or for damages caused by data acquired from services; nor shall it be held accountable for information, data, reliability and accuracy of services posted by members.
• 3. <InnoGate> shall in principle provide all information and services free of charge to all users who comply with the terms and conditions of use.

Article 12 (Provision of Information and Posting of Promotional Materials)

• 1. <InnoGate> shall provide its members with service operation and information via the service screen, homepage, and email.
• 2. Promotional materials that are deemed appropriate to services or that can be widely used shall be posted.

Article 13 (Contents)

• 1. Users shall have rights to and take responsibility for the contents they post.
• 2. <InnoGate> shall have the right to edit or move the contents posted by users within <InnoGate> without prior notice, and shall be allowed to make use of the contents for non-commercial purposes.
• 3. Content shall be deleted without prior notice for the following reasons.
• If it might or could cause harm to others
• If it is deemed to be illegal, obscene or vulgar
• If it undermines public order or established social morals and good manners
• If it is recognized to be involved in illegal activities
• If it infringes on other rights including copyright of a third party
• If it pertains to activities prohibited in accordance with related laws or if it violates the terms and conditions of this service
• If it is deemed to be necessary by an administrator due to its inappropriate contents
• 4. Unless there are reasons to believe that <InnoGate> undertook grave mistakes or gross negligence, <InnoGate> shall not take responsibility for a third party’s linked website, data contents, advertisements, and products.

Article 14 (Obligations of InnoGate)

• 1. <InnoGate> shall make efforts to enable users to benefit from seamless services at all times.
• 2. <InnoGate> shall comply with laws and regulations regarding the operation and maintenance of services stipulated in the Act on Promotion of Information and Communications Network Utilization, the Framework Act on Telecommunications, etc.

Article 15 (Users’ Obligations)

• 1. Users shall comply with the provisions of the terms and conditions of use, related laws and regulations, guidelines for use, notices on the service, and other notifications from <InnoGate>, and shall be prohibited from conducting activities that might interfere with its business.
• 2. Users shall not be allowed to copy, duplicate, modify, translate, publish, broadcast, or otherwise use the information obtained through the service from or offer it to others without the prior consent of <InnoGate>.
• 3. Users shall be accountable for keeping their ID and password secure and take full responsibility for the consequences caused by use of their ID and password. If such problems as the use of ID or password without permission occur, they shall be immediately reported to <InnoGate>. In addition, any granted ID or password shall not be resold or transferred to others.
• 4. If users join the membership to use services, they shall provide complete information consistent with the current facts, update immediately if any information changes.
• 5. Users shall not conduct business activities using the information and services provided by <InnoGate>.

Article 16 (Immunity)

• 1. <InnoGate> shall not take responsibility for profits or losses arising from the user’s failure to obtain the expected benefits from the provision of the <InnoGate> service or the selection or use of service materials.
• 2. <InnoGate> shall not take responsibility for any disrupted use of services offered by <InnoGate> due to the fault of the user.
• 3. <InnoGate> shall not take responsibility for the contents posted on <InnoGate> or transmitted by users.
• 4. <InnoGate> shall not take any responsibility for any problems arising from commodity transactions, or money transactions among users or between a user and a third party based on services offered by <InnoGate>.

Article 17 (Jurisdictions)

If a lawsuit is filed due to disputes arising from the use of this service, a court of law exercising jurisdiction over the location of KOTRA HQ shall be the competent court.

Additional Clause

The terms and conditions of use shall take effect on September 1, 2020.

제1조(목적)

이 약관은 산업통상자원부가 주관하고 KOTRA가 운영하는 <이노게이트>의 서비스를 이용함에 있어 이용조건 및 절차, <이노게이트>와 이용자 간의 권리 및 의무에 관한 사항과 기타 필요한 사항을 규정함을 목적으로 합니다.

제2조(약관의 효력 및 변경)

• 1. 이 약관은 <이노게이트>에 그 내용을 공지함으로써 효력이 발생합니다.
• 2. 약관의 내용을 변경할 경우, 적용 일자와 변경 사유를 명시하여 현행약관과 함께 본 사이트에 적용 일자 7일 전부터 적용 일자 전일까지 공지합니다. 이용자에게 불리하게 약관 내용을 변경하는 경우에는 최소한 30일 이상의 사전 유예기간을 두고 공지합니다.
• 3. 변경된 약관에 동의하지 아니하는 경우, 이용자는 <이노게이트> 회원에서 탈퇴 할 수 있으며, 계속 사용의 경우는 변경된 약관에 동의하는 것으로 간주합니다.

제3조(약관 외 준칙)

이 약관에 명시되지 않은 사항은 전기통신기본법, 전기통신사업법, 정보통신윤리위원회심의규정, 정보 통신 윤리강령, 컴퓨터 프로그램보호법 및 기타 관련 법령의 규정에 따릅니다.

제4조(용어의 정의)

• 1. 서비스 : <이노게이트>에서 제공하는 정보(프로그램 소개, 행사소개, 편의정보, 뉴스레터 등)를 말합니다.
• 2. 회원 : <이노게이트>에 기업정보를 등록한 기업회원, 개인정보를 제공한 개인회원 및 투자자로 회원가입을 한 자로서, <이노게이트>가 제공하는 서비스를 이용할 수 있는 주체를 말합니다.
• 3. 이용자 : <이노게이트>가 제공하는 서비스를 받는 자를 말합니다.

제5조(이용계약의 성립)

• 1. 이용계약은 이용자가 <이노게이트>가 정한 양식에 따라 회원정보를 기입한 후, 본 약관에 동의한다는 의사표시를 함으로써 성립합니다.
• 2. <이노게이트>는 1.항과 같이 회원 가입을 신청한 이용자 중 다음 각 호에 해당하는 경우 가입을 취소 할 수 있습니다.
• 허위나 중복으로 가입신청을 한 경우
• 공공질서 또는 미풍양속을 저해할 목적으로 신청하였을 경우
• 본 약관을 위반하거나 <이노게이트>의 운영에 현저한 지장이 있는 경우
• 기타 <이노게이트> 관리자가 필요하다고 인정하는 경우

제6조(회원정보 사용에 대한 동의)

• 1. 회원의 개인정보에 대해서는 본 사이트의 개인정보처리방침이 적용됩니다.
• 2. 취득한 회원정보는 <이노게이트>을 운영하거나 개선하는 목적으로만 사용합니다.
• 3. <이노게이트>가 취득한 회원정보는 본인의 승낙 없이 제3자에게 공개하지 않습니다.
• 4. <이노게이트>는 다음과 같은 경우에 법에서 허용하는 범위 내에서 이용자의 성명, 전자우편주소 등 개인정보를 제3자에게 제공할 수 있습니다.
• 이용자가 서비스를 이용함에 있어 관련 법률을 위반하여 수사기관이나 기타 정부 기관으로부터 정보제공을 요청 하는 경우
• 이용자의 법률위반, 본 약관위반을 포함하여 부정행위 완료 등의 정보보호업무를 위해 필요한 경우
• 기타 법률에 따라 요구되는 경우

제7조(회원정보의 변경)

회원은 회원가입 시 기재한 개인정보가 변경되었을 경우 온라인으로 직접 수정하거나 관리자에게 수정을 요구할 수 있습니다. 변경하지 않은 정보로 인해 발생되는 문제에 대한 책임은 회원에게 있습니다.

제8조(회원 탈퇴 및 취소)

• 1. 이용자가 회원탈퇴를 하고자 하는 때에는 <이노게이트>의 회원탈퇴 절차에 의하거나 전화나 전자메일 등을 통하여 신청을 해야 합니다.
• 2. 회원에게 다음 각 항에 해당하는 사유가 발생하였을 경우 <이노게이트>는 사전 통보 없이 회원가입을 취소할 수 있습니다.
• 타 회원 ID 및 비밀번호를 도용한 경우
• 타인에게 해를 입히거나 입힐 수 있는 행위를 하는 경우
• 사행행위 조장, 저속·음란물 게시 등 공공질서, 미풍양속을 저해하는 행위를 계획 또는 실행한 경우
• 부당한 방법으로 타인의 정보를 훼손하거나 타인의 개인정보를 수집, 저장, 침해, 도용 또는 누설하는 행위를 하는 경우
• 불필요하거나 승인되지 않은 광고, 판촉물 게재, 정크메일, 스팸메일을 발송하는 경우
• 수신자의 명시적인 수신거부 의사에 반하는 광고성 전자우편을 전송하는 경우
• 관련 법률에서 금지하는 행위 또는 이 약관을 위반하는 행위를 하는 경우
• 기타 <이노게이트> 관리자가 필요하다고 인정하는 경우

제9조(서비스 이용시간)

• 1. 관리자의 직접적인 지원을 받지 않는 서비스의 이용 시간은 특별한 지장이 없는 한 행사 개최 기간 내 종일(1일 24시간) 이용할 수 있습니다. 다만, 천재지변, 시스템 점검 등의 사유로 서비스를 중단할 수 있습니다.
• 2. 관리자가 직접 제공하는 서비스는 <이노게이트> 근무시간을 원칙으로 합니다.

제10조(서비스 제공의 제한 및 중단)

• 1. <이노게이트>는 다음의 경우에 서비스 제공을 일부 또는 전부를 제한하거나 중단할 수 있습니다.
• 천재지변, 국가 비상사태, 정부 예산의 변경 등 기타 불가항력의 사유가 발생하거나 발생할 우려가 있는 경우
• 서비스 설비의 보수, 공사 또는 장애로 인한 경우
• 서비스 이용의 폭주 등으로 이용에 지장이 있을 경우
• 기간통신사업자가 전기통신서비스를 중지했을 경우
• 기타 <이노게이트> 관리자가 필요하다고 인정하는 경우
• 2. 서비스 중단으로 발생되는 문제에 대하여 <이노게이트>는 책임을 지지 않습니다.

제11조(서비스의 변경 및 회원 서비스)

• 1. 이용자에 대한 서비스의 내용은 <이노게이트>의 정책에 의해 결정되며 변경 또는 중단될 수 있습니다.
• 2. <이노게이트>는 이용자가 서비스를 이용하여 기대하는 손익이나 서비스를 통하여 얻은 자료로 인한 손해에 관하여 책임을 지지 않으며, 회원이 본 서비스에 게재한 정보, 자료, 사실의 신뢰도, 정확성 등 내용에 관하여 책임을 지지 않습니다.
• 3. <이노게이트>는 이 약관을 준수하는 이용자 모두에게 모든 정보와 서비스를 무료로 제공하는 것을 원칙으로 하고 있습니다.

제12조(정보 제공 및 홍보물 게재)

• 1. <이노게이트>는 서비스의 운영 및 정보를 서비스 화면, 홈페이지, 전자우편 등의 방법으로 회원에게 제공할 수 있습니다.
• 2. 서비스에 적절하다고 판단되거나 활용 가능성 있는 홍보물을 게재할 수 있습니다.

제13조(컨텐츠)

• 1. 이용자가 게시한 컨텐츠의 내용에 대한 권리와 책임은 해당 이용자에게 있습니다.
• 2. <이노게이트>는 이용자가 게시한 컨텐츠를 사전 통지 없이 <이노게이트> 내에서 편집, 이동할 수 있는 권리를 보유하며, 비상업적 목적으로 이용자의 컨텐츠를 활용할 수 있습니다.
• 3. 다음의 경우 사전 통지 없이 컨텐츠를 삭제할 수 있습니다.
• 타인에게 해를 입히거나 입힐 수 있는 내용을 포함한 경우
• 불법, 음란, 저속하다고 판단되는 게시물을 게시한 경우
• 공공질서 및 미풍양속에 위반되는 내용인 경우
• 범죄적 행위에 결부된다고 인정되는 내용인 경우
• 제3자의 저작권 등 기타 권리를 침해하는 내용인 경우
• 관련 법률에서 금지하는 행위 또는 본 서비스의 약관의 내용에 위배되는 경우
• 기타 적절하지 못한 내용을 담고 있는 등 관리자가 필요하다고 인정하는 경우
• 4. <이노게이트>에 고의나 중과실이 인정될 만한 특별한 사유가 있는 경우를 제외 하고는 <이노게이트>내에서 링크된 제3자의 웹사이트 및 자료의 내용, 광고, 제품 등에 대해 책임을 부담하지 않습니다.

제14조(<이노게이트>의 의무)

• 1. <이노게이트>는 이용자가 안정적으로 서비스를 받을 수 있도록 항상 노력합니다.
• 2. <이노게이트>는 정보통신이용촉진에관한법률, 전기통신기본법 등 서비스의 운영, 유지와 관련 있는 법규를 준수합니다.

제15조(이용자의 의무)

• 1. 이용자는 본 약관의 규정, 관계 법령, 이용안내 및 서비스상에 공지한 주의사항, 기타 <이노게이트>가 통지하는 사항을 준수하여야 하며, 업무에 방해되는 행위를 하여서는 안됩니다.
• 2. 이용자는 서비스를 이용하여 얻은 정보를 <이노게이트>의 사전 승낙 없이 복사, 복제, 변경, 번역, 출판, 방송 기타의 방법으로 사용하거나 이를 타인에게 제공할 수 없습니다.
• 3. 이용자는 본인의 책임 하에 ID와 비밀번호의 보안을 유지하셔야 하며, 자신의 ID와 비밀번호를 사용하여 발생하는 모든 결과에 대해 전적인 책임이 있습니다. 본인의 승인 없이 ID나 비밀번호가 사용되는 등 문제가 발생하시면 즉시 <이노게이트>에 신고하셔야 합니다. 또한 부여받은 ID 및 비밀번호는 타인에게 전매 또는 양도할 수 없습니다.
• 4. 이용자는 서비스 이용을 위해 회원으로 가입할 경우 현재의 사실과 일치하는 완전한 정보를 제공하셔야 하며, 정보에 변경사항이 발생할 경우 즉시 갱신하셔야 합니다.
• 5. 이용자는 <이노게이트>가 제공하는 정보와 서비스를 이용하여 영업활동을 할 수 없습니다.

제16조(면책 조항)

• 1. 이용자가 <이노게이트> 서비스 제공으로부터 기대되는 이익을 얻지 못하였거나 서비스자료에 대한 취사선택 또는 이용으로 발생하는 손익에 대하여 <이노게이트>는 책임을 지지 않습니다.
• 2. <이노게이트>는 이용자의 귀책 사유로 인한 <이노게이트> 이용의 장애에 대하여 책임을 지지 않습니다.
• 3. <이노게이트>는 이용자가 <이노게이트>에 게시하거나 또는 전송한 내용에 관하여는 책임을 지지 않습니다.
• 4. 이용자 상호간 또는 이용자와 제3자 상호간에 <이노게이트> 서비스를 매개로 한 물품거래, 금전거래 등과 관련하여 발생한 문제에 대하여 어떠한 책임도 지지 않습니다.

제17조(관할 법원)

본 서비스 이용과 관련하여 발생한 분쟁에 대해 소송이 제기될 경우 대한무역투자진흥공사 소재지를 관할하는 법원을 관할 법원으로 합니다.

부칙

본 약관은 2020년 9월 1일부터 시행됩니다.
